These Terms of Use (“Terms”) govern your access to and use of this website, its related pages and subdomains, online menus, ordering features, newsletters, promotional content, blog content, and other digital services operated for The Sweet Spot Dispensary (“The Sweet Spot,” “we,” “us,” or “our”), collectively referred to as the “Site.”

Please read these Terms carefully. By accessing or using the Site, creating an account, subscribing to communications, submitting information, or placing an order through the Site, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use the Site.

1. Eligibility and Age Requirements

The Site is intended primarily for persons who are at least 21 years old.

Certain cannabis purchasing services may be legally available to qualified medicinal cannabis patients who are at least 18 years old and possess a valid physician’s recommendation or other documentation required by applicable law. Access to such services remains subject to age, identity, eligibility, and documentation verification.

By accessing or using the Site, you represent and warrant that:

  1. You satisfy the minimum legal age and eligibility requirements applicable to you;
  2. You have the legal capacity to enter into a binding agreement;
  3. The information you provide is truthful, current, and complete;
  4. You will not allow a minor or other ineligible person to use your account or access restricted services through you; and
  5. You will comply with all applicable federal, state, and local laws.

You may not bypass, disable, misrepresent information to, or otherwise interfere with any age gate, identity-verification process, purchase restriction, or other eligibility control.

We may deny access, cancel an order, suspend an account, or request additional documentation when we cannot verify a user’s age, identity, eligibility, or compliance with applicable law.

2. California Cannabis Laws and Federal Law

Cannabis may be lawful for certain medicinal and adult-use purposes under California law. Cannabis remains restricted or prohibited under federal law and may also be restricted by local laws, property rules, employment policies, immigration rules, contractual obligations, and other requirements.

You are solely responsible for understanding and following all laws and restrictions applicable to your possession, purchase, transportation, storage, and use of cannabis.

Without limitation:

  • Cannabis may not be transported across state lines.
  • Cannabis may not be possessed or used on federal property where prohibited.
  • Driving or operating a vehicle, boat, machinery, or equipment while impaired is prohibited.
  • Cannabis may not be furnished, transferred, or made accessible to minors or other ineligible persons.
  • Cannabis may not be resold, diverted, exported, or used for an unlawful commercial purpose.
  • Cannabis may not be consumed in public or in other locations where consumption is prohibited.
  • Property owners, employers, landlords, hotels, event operators, and other parties may impose additional restrictions.

The availability of cannabis under California law does not eliminate or reduce your responsibility to comply with federal law or other applicable restrictions.

3. Purpose of the Site

The Site provides information about The Sweet Spot, including locations, products, brands, promotions, educational topics, events, store hours, and available purchasing options.

The Site may allow users to:

  • Browse cannabis products and accessories;
  • Review estimated prices, product information, and availability;
  • Create or access an online account;
  • Submit a pickup order or, where expressly offered, a delivery order;
  • Subscribe to newsletters and promotional communications;
  • View blog articles and educational content;
  • Review promotions, events, and store information; and
  • Access third-party websites or services.

Content displayed on the Site is provided for general informational and commercial purposes. It is not medical, legal, financial, employment, or other professional advice.

4. Online Ordering and Third-Party Platforms

Some online-menu, account, age-verification, payment, ordering, pickup, delivery, or related functions may be operated by Sweede.io or another third-party technology or service provider.

Your use of a third-party platform may be subject to that provider’s own terms, privacy policy, eligibility requirements, and technical procedures. Those additional terms may form a separate agreement between you and the third-party provider.

The Sweet Spot is not responsible for a third party’s independent acts, omissions, privacy practices, security procedures, outages, errors, or contractual terms, except to the extent liability cannot legally be excluded.

If these Terms conflict with purchase-specific conditions communicated during checkout, the purchase-specific conditions will control solely with respect to that transaction.

5. Accounts and Account Security

Certain Site functions may require an account. When creating or using an account, you agree to provide accurate, current, and complete information.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;
  • Restricting access to your account and device;
  • All activity conducted through your account;
  • Promptly updating inaccurate or outdated information; and
  • Promptly notifying us of suspected unauthorized account activity.

You may not create an account using another person’s identity, identification, medical documentation, payment information, or contact details without lawful authorization.

We may suspend or terminate accounts that contain false information, are used unlawfully, create security concerns, violate these Terms, or interfere with our legal obligations.

6. Orders Are Requests Until Accepted

Submitting an online order does not guarantee that the order has been accepted or that any product is reserved.

An order becomes accepted only when the applicable store or ordering platform confirms acceptance. Automated messages acknowledging receipt do not necessarily constitute final acceptance.

We reserve the right, subject to applicable law, to reject, limit, correct, or cancel an order for reasons including:

  • Product unavailability;
  • Incorrect pricing or product information;
  • Technical or inventory errors;
  • Purchase-limit restrictions;
  • Suspected fraud;
  • Inability to verify age, identity, or eligibility;
  • Payment problems;
  • Store closure or operational disruption;
  • Suspected resale or diversion;
  • Safety concerns; or
  • Legal or regulatory requirements.

If payment was collected for an order that we cancel, any required refund will be processed in accordance with applicable law and the procedures of the applicable payment provider.

7. Product Availability, Information, and Pricing

Product selection, potency, cannabinoid content, packaging, brands, sizes, prices, discounts, and availability may vary by location and may change without notice.

Online inventory information may be delayed, incomplete, or inaccurate. Displaying a product on the Site does not guarantee that the product is currently available.

Product images are illustrative. Actual packaging, color, appearance, batch information, ingredients, cannabinoid content, terpene content, warnings, and other characteristics may differ.

The product’s current physical label and packaging control if website information differs from the product received at the store.

Prices may not include all applicable taxes, fees, deposits, service charges, or other amounts unless expressly stated. The final price will be communicated at checkout or at the time of the completed transaction.

We may correct typographical errors, pricing errors, inventory errors, product-description errors, or other mistakes at any time, including after an order has been submitted.

8. Purchase Limits and Verification

All purchases are subject to applicable legal purchase and possession limits.

You may be required to present an acceptable, valid, unexpired government-issued photo identification document at pickup or delivery. Qualified medicinal patients may also be required to present a valid physician’s recommendation, medical marijuana identification card, or other required documentation.

An online age gate, account, uploaded document, or order confirmation does not replace final in-person or delivery verification.

We may refuse to complete a transaction when:

  • The customer does not present acceptable identification;
  • The customer’s identity does not match the order information;
  • Required medicinal documentation is unavailable or invalid;
  • The customer appears impaired in a manner that makes the transaction unsafe or unlawful;
  • Completing the transaction would exceed a legal purchase limit; or
  • Completion would otherwise violate law or store policy.

9. Pickup and Delivery

Online services may offer in-store pickup and, at certain times or locations, delivery. The availability of either option is not guaranteed.

Pickup orders must be collected at the selected store during the applicable pickup period. The person collecting the order may be required to be the person named in the order.

Where delivery is offered:

  • Delivery is available only within authorized service areas;
  • The recipient must satisfy all legal eligibility and identification requirements;
  • Delivery times are estimates and are not guaranteed;
  • Orders may not be delivered to prohibited locations;
  • The recipient may not redirect the order to an unauthorized person or address; and
  • The order may be returned or canceled if lawful delivery cannot be completed.

We do not ship or deliver cannabis across state lines.

10. Cancellations, Returns, Exchanges, and Refunds

The availability of cancellations, returns, exchanges, credits, or refunds depends on applicable law, product condition, safety requirements, and the policy communicated by the applicable store at the time of sale.

Because cannabis products are regulated goods, certain products may not be eligible for return or resale after leaving the licensed premises.

Nothing in these Terms limits any refund, replacement, or other remedy that cannot legally be waived, including remedies relating to defective, recalled, mislabeled, damaged, or incorrectly supplied products.

Contact the applicable store promptly if you believe there is a problem with an order. Retain the product, packaging, label, receipt, and batch information until the matter is reviewed.

11. Promotions, Discounts, and Events

Promotions, daily deals, happy-hour offers, discounts, events, giveaways, and special pricing are subject to any additional terms displayed with the offer.

Unless expressly stated otherwise:

  • Offers are available only while supplies last;
  • Offers may be limited to particular stores, products, brands, dates, or customers;
  • Discounts may not be combined;
  • Taxes and regulatory fees may still apply;
  • Offers have no cash value;
  • Purchase limits continue to apply;
  • Products may be excluded;
  • Errors may be corrected; and
  • We may modify or discontinue an offer as permitted by law.

Event schedules, participating brands, guests, products, and activities may change without notice. Participation in an event may require acceptance of additional rules or waivers.

12. Educational Content and Product Guidance

The Site may contain articles, descriptions, comparisons, guides, staff recommendations, product categories, strain information, terpene information, customer reviews, testimonials, and other educational or promotional materials.

This content is general information only. It is not a diagnosis, prescription, treatment recommendation, or substitute for advice from a qualified healthcare professional.

Statements about expected effects, experiences, flavors, aromas, onset times, duration, or product characteristics are not guarantees. Cannabis affects individuals differently.

You should consult an appropriate healthcare professional before using cannabis, particularly if you:

  • Are pregnant, may be pregnant, or are breastfeeding;
  • Take prescription or nonprescription medications;
  • Have a cardiovascular, respiratory, psychiatric, neurological, liver, kidney, or other medical condition;
  • Have a history of substance-use problems;
  • Are preparing for surgery;
  • Are sensitive to cannabis, smoke, vapor, or specific ingredients; or
  • Have questions concerning interactions or side effects.

13. Marketing and Electronic Communications

When you provide contact information, submit an order, create an account, or communicate with us electronically, you consent to receive transaction-related electronic communications, such as order confirmations, account notices, security messages, and service updates.

When you separately subscribe to marketing communications, you authorize us and our service providers to send promotional emails consistent with your consent and applicable law.

You may unsubscribe from promotional emails through the unsubscribe mechanism included in those messages. Unsubscribing from marketing does not prevent necessary transactional or legally required communications.

You are responsible for ensuring that the contact information you provide belongs to you and is accurate.

14. Privacy and Cookies

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

The Site may use cookies, analytics technologies, preference controls, and third-party services. Your use of the Site is also subject to the cookie choices and disclosures presented through the Site.

By using the Site, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure.

15. Intellectual Property Rights

The Site and its contents, including text, articles, graphics, photographs, videos, logos, trademarks, trade dress, page designs, software, databases, compilations, and other materials, are owned by or licensed to The Sweet Spot and are protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Site for lawful, noncommercial purposes.

You may not, without prior written authorization:

  • Copy, reproduce, distribute, republish, display, or transmit Site content for commercial purposes;
  • Modify or create derivative works from Site content;
  • Use our names, logos, trademarks, or branding in a misleading manner;
  • Frame, mirror, or reproduce substantial portions of the Site;
  • Remove copyright, trademark, attribution, or proprietary notices;
  • Use Site content to build a competing product, menu, database, or service; or
  • Suggest an affiliation, sponsorship, or endorsement that does not exist.

Product names, photographs, descriptions, and trademarks belonging to third-party manufacturers remain the property of their respective owners.

16. User Content and Feedback

If the Site permits you to submit comments, reviews, photographs, messages, feedback, or other content, you retain ownership of your original content.

By submitting content, you grant The Sweet Spot a worldwide, nonexclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, adapt, publish, display, distribute, and use that content in connection with operating, improving, and promoting the Site and our business, subject to applicable privacy law.

You represent that:

  • You own or have permission to submit the content;
  • The content is accurate to the best of your knowledge;
  • The content does not violate another person’s rights;
  • The content is not deceptive, defamatory, threatening, obscene, or unlawful;
  • The content does not promote sales to minors or unlawful cannabis activity; and
  • Your submission does not violate confidentiality or contractual obligations.

We may moderate or remove user content but are not obligated to do so.

Feedback and suggestions concerning the Site or our services may be used without restriction or compensation, unless otherwise agreed in writing.

17. Prohibited Conduct

You may not use the Site to:

  • Violate any law, regulation, court order, or third-party right;
  • Facilitate unlawful cannabis activity;
  • Purchase for or transfer products to an ineligible person;
  • Misrepresent your age, identity, eligibility, location, or medical status;
  • Commit fraud or use unauthorized payment information;
  • Harass, threaten, impersonate, or harm another person;
  • Upload malware, malicious code, or harmful material;
  • Attempt to gain unauthorized access to an account, server, network, or database;
  • Interfere with the Site’s operation or security;
  • Circumvent access controls, purchase limits, or verification measures;
  • Scrape, harvest, index, or extract Site data through unauthorized automated means;
  • Conduct vulnerability testing without written authorization;
  • Reverse engineer Site software except where the restriction is prohibited by law;
  • Send spam or unsolicited advertising;
  • Manipulate reviews, ratings, promotions, or referral systems; or
  • Use the Site in a manner that could expose us, our licensees, service providers, customers, or employees to liability or regulatory action.

18. Third-Party Links and Content

The Site may link to websites, maps, social-media platforms, manufacturers, ordering systems, analytics providers, payment providers, or other third parties.

A link does not necessarily constitute an endorsement. We do not control and are not responsible for third-party content, availability, security, accuracy, products, services, or privacy practices.

Your dealings with a third party are between you and that third party. Review the applicable third-party terms and privacy policies before providing information or completing a transaction.

19. Site Availability and Changes

We may modify, suspend, restrict, discontinue, or remove any portion of the Site at any time, subject to applicable law.

We do not guarantee that the Site will be uninterrupted, secure, error-free, compatible with every device, or available at all times.

Maintenance, service-provider problems, internet disruptions, regulatory changes, emergencies, security events, and circumstances beyond our reasonable control may affect availability.

20. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL INFORMATION, FEATURES, CONTENT, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

THE SWEET SPOT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

WE DO NOT WARRANT THAT:

  • THE SITE WILL SATISFY YOUR REQUIREMENTS;
  • INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR ERROR-FREE;
  • A PRODUCT WILL PRODUCE A PARTICULAR EXPERIENCE OR RESULT;
  • PRODUCTS DISPLAYED ONLINE WILL REMAIN AVAILABLE;
  • PROMOTIONS WILL REMAIN IN EFFECT;
  • DEFECTS OR INTERRUPTIONS WILL BE CORRECTED; OR
  • THE SITE WILL BE FREE FROM HARMFUL COMPONENTS.

Some jurisdictions do not allow certain warranty exclusions. In that event, the exclusions apply only to the maximum extent permitted by law.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SWEET SPOT AND ITS OWNERS, LICENSEES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, BUSINESS, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATING TO THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID DIRECTLY TO THE SWEET SPOT THROUGH THE APPLICABLE SITE TRANSACTION GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS.

These limitations do not apply to liability that cannot lawfully be limited, including liability resulting from fraud, intentional misconduct, gross negligence where legally non-waivable, or personal injury caused by conduct for which liability cannot be excluded.

Nothing in these Terms limits rights or remedies available under non-waivable consumer-protection law.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Sweet Spot and its owners, affiliates, licensees, officers, employees, contractors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Site;
  • Your violation of these Terms;
  • Your violation of another person’s rights;
  • Information or content you submit;
  • Your misrepresentation of age, identity, eligibility, or authority; or
  • Your furnishing, resale, diversion, transportation, storage, or use of cannabis in violation of law.

This section does not require you to indemnify a party for that party’s own unlawful conduct where such indemnification is prohibited.

23. Suspension and Termination

We may suspend, restrict, or terminate your access to the Site when we reasonably believe you have violated these Terms, created a security or legal risk, supplied false information, engaged in fraud, interfered with Site operations, or used the Site unlawfully.

You may stop using the Site at any time.

Sections that by their nature should survive termination—including intellectual-property, warranty, liability, indemnification, dispute, and miscellaneous provisions—will remain effective.

24. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where another law must apply.

Any dispute that is not required by law to be brought elsewhere will be brought in the state or federal courts having jurisdiction over Santa Rosa or Sonoma County, California.

You and The Sweet Spot consent to the personal jurisdiction of those courts.

Nothing in this section prevents either party from bringing an eligible matter in small-claims court or exercising a right that cannot legally be waived.

25. Changes to These Terms

We may update these Terms to reflect changes in our operations, technology, services, laws, or regulatory obligations.

Updated Terms will be posted with a revised Effective Date. Changes apply prospectively unless applicable law requires otherwise.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms. When legally required, we will provide additional notice or obtain renewed consent.

26. Miscellaneous

These Terms, together with the Privacy Policy, Disclaimer, and any applicable purchase-specific terms, constitute the entire agreement concerning your use of the Site.

If a provision is found unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, change of control, or operation of the Site.

Headings are for convenience only and do not affect interpretation.

No agency, employment, partnership, joint venture, fiduciary, or franchise relationship is created through your use of the Site.
